The subject of this panel remains one of the most controversial areas of the law. Everyone asks for an independent medical evaluation in virtually every claim. Is the claimant entitled to multiple independent medical evaluations in different specialties? Can the claimant schedule his own independent medical evaluation? What if the independent medical evaluator wants to treat – is that allowed? Can the claimant declare his unauthorized doctor an independent medical evaluator? Many cases have come out in the last year or two on this subject, but are they consistent? If a defense lawyer asks for an EMA late in the proceeding, does the Judge have to give him one? Once the EMA renders his opinion, does the Judge have to go along with it? If the parties don’t ask for an EMA, can the Judge still appoint one? Workers’ compensation managed care can provide an excellent service to Florida’s employers, but there is often confusion as to what is required by law, and what is just prudent business practice. There is a lot of difference between how different MCO’s price their services. These costs are typically not discussed at proposal time, but often cost more than the broker’s fee, or the insurance piece itself. Discussed in this session will be what the managed care statute by definition requires an employer to do, who these services are performed by, how they are picked, and how to purchase them in a manner that future costs can be predicted (i.e., capitation).
